GENERAL CONDITIONS OF SALE – CGV

These general terms and conditions of sale are concluded between, on the one hand, AYA HORIZONS, a simplified joint-stock company with a share capital of €1000, registered in the RCS of Pontoise, n° 89090278600015, whose registered office is at 3 rue Camille Pelletan 95190 Goussainville, Intracommunity VAT number FR52890902786, and on the other hand, any individual or professional wishing to make a purchase through the website www.ayahorizons.com, exclusive property of AYA HORIZONS.

 General provisions :

These conditions govern the sale of any product presented on the site www. ayahorizons.com by the company AYA HORIZONS. They define the reciprocal obligations of the parties as well as the different stages of the ordering process. These terms may be subject to change. Therefore, the applicable conditions are those in force on the site at the time of signing the contract. The parties agree that their relations will be exclusively governed by this contract, to the exclusion of any other condition. Any order duly validated on the website www. ayahorizons.com implies total and unreserved acceptance of these general conditions of sale.

Products

The articles visible on the site www. ayahorizons.com can only be delivered within the limits of available stocks. If the product is not available, AYA HORIZONS undertakes to inform the buyer as soon as possible by e-mail or telephone. The buyer will then have the option of choosing another item of the same value or being reimbursed by canceling his order. Any customer complaint regarding the order or delivery of an unavailable item will be considered unfounded. AYA HORIZONS strives to describe the products offered for sale with the greatest possible accuracy. If errors may have occurred in this presentation, AYA HORIZONS cannot be held liable. The illustrations and photos of the products in support of the text do not enter into the contractual field.  

Price

The prices indicated on the site www.ayahorizons.com are in euros, VAT included (TTC). VAT is applied at the rate in force in mainland France at the time of the order. Any rate change would be applied immediately to the current order. Product prices are exclusive of shipping costs, which are extra. These will be brought to the attention of the buyer on the summary screen before final validation of the order. Prices shown are subject to change at any time without notice. However, the items will be invoiced on the basis in force when the order is recorded. In the event of an order to a country other than metropolitan France, customs duties or other local taxes (local VAT, customs tax, import duties, etc.) may be payable. These rights are the sole responsibility of the customer and are their full responsibility both in terms of declarations and payment to the competent authorities. All orders, regardless of their origin, are invoiced and payable in Euros only. The products remain the property of AYA HORIZONS until full payment of the price, regardless of the date of delivery of the product.

Order

Only persons legally capable of signing Contracts concerning the goods and services offered on the site, can Order on the site www. ayahorizons com. At the time of the order, the Customer guarantees to have full legal capacity to adhere to these general conditions and thus conclude this Contract.

Any order placed on the website www. Ayahorizons.com constitutes the formation of a contract concluded at a distance between the Customer and the Seller. Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of all transactions concluded with the Customer.

The Customer must verify all the information entered during his Order (Product ordered, delivery and billing addresses, contact details, etc.).

The Seller cannot be held responsible for any errors in data entry by the Customer or for the consequences in terms of delay or error in delivery. Thus, if the delivery cannot take place due to an input error by the Customer, the reshipping costs will be borne by the Customer. In this case, the Customer will refrain from any claim due to delivery times.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order. The Customer will be able to follow the progress of his order on the site.

Payment

AYA HORIZONS offers the Customer various payment methods: By PAY Pal, bank card (Carte Bleue, Visa, Mastercard, Eurocard, American Express): the customer must indicate the number of his card, as well as its expiry date and the three digits of the cryptogram on the back of it, directly in the area provided for this purpose (secure entry by SSL encryption). The amount of orders paid by credit card is collected on the day the order is dispatched (only the products delivered are invoiced). In the case of multi-item orders, the full amount of the orders is collected on the day of shipment of the first item. By check payable in France made payable to AYA HORIZONS Your order will be processed upon receipt of the check.

It is essential to mention on the back of the check the number assigned at the end of the order. The amount of orders paid by check is cashed upon receipt of the check (only the products delivered are invoiced) In the event of an error, the overpayment is refunded to the customer by check or bank transfer within fifteen days. If your check has not reached us within 10 days from the date of the order, the latter will be canceled by us. 

Delivery

The items are delivered to the delivery address indicated when ordering. In order to optimize delivery, it is advisable to indicate an address at which your order can be received during working hours.

Any communication of false information is contrary to these General Conditions of Sale.

The choice of carrier will be the responsibility of AYA HORIZONS, with the tracking option for its order.

For shipments outside mainland France, shipping costs are invoiced excluding VAT. Customs or import taxes are not included in the delivery costs indicated and are the responsibility of the customer.

The deadlines announced on the site are purely indicative and depend on the destination and the availability of the product ordered. Exceeding this period cannot give rise to any order cancellation, to any reduction in the price paid by the buyer, and to any payment for damages. However, and in accordance with the provisions of article L.121-20-3 of the Consumer Code, for lack of delivery at the end of a period of thirty days from the following day on which the customer placed his order, the customer will have the possibility of canceling his order free of charge. The sums he has paid will then be refunded to him. In cases where it has the capacity, AYA HORIZONS reserves the right to offer it a product of quality and price equivalent to the initial product.

Withdrawal period

Pursuant to Article L. 221-18 of the Consumer Code, the buyer has a period of 14 days to exercise his right of withdrawal. Within 14 days of the date of receipt of the goods ordered, the buyer may request an exchange or refund of the item(s) purchased. The exchange will only be possible within the limit of our stocks.

Beyond the 14-day period, AYA HORIZONS will be free to refuse the exchange or refund.

The exchange or refund procedure is as follows:

The buyer must inform AYA HORIZONS of his wish to withdraw within 14 days of receipt of his order, by email or telephone.

The buyer returns, at his own expense, the product(s) as well as the duly completed return slip by registered mail or tracked parcel to the following address:

If the customer opts for a refund, AYA HORIZONS will reimburse the customer for the price of the product(s) (delivery costs included) within a maximum period of 14 days from the date on which AYA HORIZONS is informed of the customer’s decision to withdraw, provided that the product is returned in perfect condition. Reimbursement may be deferred until recovery of the products or proof of shipment of the products by the customer. The date chosen is that of the first of these events. The refund will be made using the same payment method used for the initial transaction. In case of use of a virtual payment card, the refund will be made by check sent to the customer’s home.

The costs of returning the product(s) to be exchanged are the responsibility of the customer.

Legal guarantees

The products sold benefit from the legal guarantee of conformity provided for by articles 211-4 and following of the consumer code and the guarantee against hidden defects (articles 1641 and following of the civil code). These warranties cover hidden defects and visible defects from the date of delivery. The only obligation incumbent on AYA HORIZONS under this warranty is, at its option, the free replacement or repair of products found to be defective without further benefit or compensation.

Privacy

All the personal information collected from the customer is necessary for the processing of the order, its delivery and the establishment of the invoice.

This information may be distributed by AYA HORIZONS to its contractual partners as part of the fulfillment of the order, in particular to ensure the transport of the products ordered.

AYA HORIZONS undertakes to protect this data concerning the customer. In accordance with the law “Informatique et Libertés” of 06/01/1978, modified by the law of August 6, 200.

In accordance with article 34 of this same law, the customer has the right to access, modify, rectify and delete data concerning him. In this case, the customer can modify his personal information directly in the “My account” section on the website www.ayahorizons.com

When creating a customer account on the site www.ayahorizons.com, AYA HORIZONS offers the possibility of receiving by e-mail, via the « Newsletter », information on events, exclusive offers, special promotions, news from AYA HORIZONS. The customer may decide, at any time, to no longer receive this « Newsletter » by unsubscribing using the unsubscribe link included in the footer of the e-mail.

Responsibility

AYA HORIZONS cannot be held liable for non-performance of the Contract in the event of force majeure, disruption or total or partial strike, in particular of postal services and means of transport, communications (computer network failure, etc.), flood, fire, etc

These various incidents would have the effect of suspending the Seller’s obligations and pursuant to article 1218 of the Civil Code, there is no need for any damages when, as a result of a case of force majeure or fortuitous event, the debtor was prevented from giving or doing what he was obliged to do. AYA HORIZONS will not incur any liability for any consequential damages as a result of these presents, operating loss, loss of profit, damages or costs, which may arise.

Jurisdiction

These general conditions of sale are subject to French law. Any dispute that has not found an amicable solution will be subject to the exclusive jurisdiction of the competent courts of Pontoise or to the jurisdiction of the actual place of delivery of the customer’s order, notwithstanding multiple defendants and/or warranty claims, even for emergency procedures or conservatory procedures in summary proceedings or by motion.
